Modifying a Divorce Decree

A divorce decree is not necessarily permanent. If there has been a significant change in circumstances in the lives of those affected by an alimony, child support or child custody decree, a modification may be granted.

Alimony / Spousal Support
If there has been a substantial change in economic circumstances of either party based on need or ability to pay, it may be possible to modify an alimony decree. However, this applies only if the decree is modifiable.
It may also be possible to enforce alimony payments. In a failure-to-pay situation where the paying spouse is refusing to make payments, the receiving spouse can seek an enforcement for missed alimony payments.
Child Support
A change in economic status can warrant a modification of child support:
- Job loss
- Change in alimony
- Change in the needs of the child
- Relocation with the child

Child Custody
Family law courts in Florida do not grant child custody modifications easily. There must be a significant change in circumstances for a modification to be approved. The courts consider the following when deciding whether to approve a child custody modification:
- New employment opportunities
- Preferences of the child
- Age of the child
- Alcohol or drug use by either parent
- Parent's ability to meet the needs of the child
There is a statute that bans one parent from relocating more than 50 miles away from the other parent. In rare circumstances, the courts will allow a move-away further than 50 miles, but in most cases, this is considered to have a negative impact on the child.
